Six compounding pharmacies are alleging in a federal lawsuit that St. Louis-based Express Scripts is trying to force them out of business in violation of antitrust law.
The plaintiffs who on Friday filed the lawsuit against the $101 billion pharmacy benefits manager in U.S. District Court for the Eastern District of Missouri were: Precision Rx Compounding LLC of Tampa, Florida; C&M Health Pro LLC of Kissimmee, Florida; Northern VA Compounders PLLC of Chantilly, Virginia; TOTH Enterprises II PA of Austin, Texas; The Daily Dose LP of Austin; and CPRx Pharmacy LP, of Cedar Park, Texas.
An Express Scripts spokesman declined to comment.
The suit, which names only Express Scripts as a defendant, said that because the company operates its own mail-order pharmacy, it stands to benefit from the “elimination of competing independent compounding and specialty pharmacies from the prescription drug market…”
